Terms and Conditions

Effective as of 21st April 2025

Every person intending to hire goods from The Picnic Collective Canberra must read and agree to the following Hire Terms and Conditions before proceeding.

1. Definitions and Interpretation

1.1 Unless the context requires otherwise:

  • Activities means the hire and use of picnic equipment and any related equipment (i.e. lawn games) owned by The Picnic Collective.

  • Additional Hire Charges means:

    • additional fees charged by The Picnic Collective where the Customer exceeds the Hire Period without prior agreement;

    • fees such as cleaning and repair fees as advised by The Picnic Collective.

  • Booking Form means any form (digital or paper) confirming booking details.

  • Claim includes any claim, demand, action, expense, damage, cost, or liability.

  • Commencement means the actual date and time the Customer takes possession of a Picnic.

  • Customer means the person or company listed on the Booking Form.

  • Event of Default means an event described in clause 8.1.

  • Hire Charge means the amount payable by the Customer to hire the Picnic.

  • Hire Period means the confirmed duration for which the Picnic is hired.

  • Location means the designated use area (e.g. Canberra) as per the Booking Form.

  • Loss means any direct or indirect damage or cost including legal expenses.

  • Participant means any individual using the Picnic equipment.

  • Picnic means the picnic equipment and any related items owned and hired out by The Picnic Collective.

  • Site refers to www.thepicniccollective.com.au or other booking platforms used by The Picnic Collective.

  • Unacceptable State means a condition in which the Picnic is returned requiring additional cleaning or maintenance, as defined below.

2. Hire of a Picnic

2.1 The Picnic Collective agrees to hire a Picnic to the Customer for the Hire Period upon confirmation and receipt of payment.

2.2 The Picnic Collective is under no obligation to hire equipment until a booking is confirmed.

2.3 Equipment will be provided in a clean and good working condition.

2.4 Risk associated with the Picnic lies with the Customer from Commencement until the end of the Hire Period.

3. Customer Obligations

3.1 The Customer must:

  • Ensure the Picnic is suitable at Commencement;

  • Provide ID and complete booking details;

  • Arrive on time;

  • Supervise children and instruct all Participants on safe use;

  • Immediately report any accidents or damages;

  • Return all items clean and tidy. If returned in an Unacceptable State, a $50 cleaning surcharge will apply.

3.2 The Customer must NOT:

  • Tamper with or damage equipment;

  • Lose or part with possession;

  • Rely on representations outside of this Agreement unless provided in writing.

4. Participant Obligations

4.1 Each Participant must:

  • Use equipment safely and legally;

  • Indemnify The Picnic Collective against any loss or injury caused;

  • Ensure they are physically fit and mentally capable;

  • Secure personal items and bring their own supplies unless agreed otherwise;

  • Declare allergies or dietary needs if catering is supplied;

  • Be 18+ or supervised by a parent/guardian.

4.2 Participants must NOT:

  • Litter, damage equipment/property;

  • Disturb wildlife or others;

  • Behave in an unsafe, loud, or illegal manner;

  • Bring illegal substances.

5. Fees and Charges

5.1 Hire Charges must be prepaid.

5.2 The Picnic Collective may charge fees to the Customer’s nominated account or card.

5.3 Additional Hire Charges apply for late returns or extended Hire Periods.

5.4 Late return fee: $50 per day.

5.5 The Hire Period remains as scheduled, regardless of actual pickup time.

5.6 If equipment is not returned, the Customer will be liable for replacement value and lost revenue.

5.7 The Customer is responsible for:

  • Loss or damage;

  • $50 cleaning surcharge if returned in an Unacceptable State, including:

    • Food waste;

    • Spills or stains;

    • Excessive mud/dirt;

    • Strong odours;

    • Rearranged displays or soaked/damaged items.

  • Fines, levies, and late payment interest (5% per month);

  • Any collection or legal costs.

5.9 All amounts owed must be paid on demand.

5.10 The Picnic Collective may increase Hire Charges but not after a booking is confirmed.

6. Cancellation Policy

6.1 A Customer may cancel a confirmed booking by notifying The Picnic Collective in writing prior to the scheduled Hire Period.

Perishable Goods

Perishable goods include food, beverages, fresh flowers, and other items that cannot be reused. Once prepared or sourced, these items are non-refundable and non-transferable.

Cancellations

  • More than 48 hours’ notice: Full credit (excluding perishable goods) toward a future booking.

  • 48 to 24 hours’ notice: Partial credit (excluding perishable goods), subject to unrecoverable costs.

  • Less than 24 hours’ notice: No credit or refund.

Weather & Other Circumstances

6.6 The Picnic Collective may reschedule bookings due to severe weather or extenuating circumstances. Customers will be notified at least 24 hours in advance and offered a rebooking option.

7. Warranties and Liability

7.1 Where applicable, Australian Consumer Law guarantees apply.

7.2 Outside of statutory guarantees, The Picnic Collective offers no additional warranties.

7.3 Participants release The Picnic Collective from all liability unless caused by proven negligence.

7.4 Liability is limited to re-supplying the service or refunding the Hire Charge.

7.5 No liability is accepted for indirect or consequential losses.

7.6 Participants are liable for insurance excesses and/or repair costs for damages caused.

8. Event of Default and Termination

8.1 An Event of Default occurs if the Customer:

  • Breaches the Agreement;

  • Fails to pay;

  • Causes equipment loss or damage.

8.2 The Picnic Collective may:

  • Refuse or cancel bookings;

  • Charge the Customer for outstanding fees;

  • Repossess equipment;

  • Take legal action.

8.3 The Customer indemnifies The Picnic Collective for any resulting loss or damage.

8.4 The Picnic Collective is not responsible for loss due to damaged or delayed equipment.

9. Catering

9.1 Food or beverage is only included if specified. Catering is charged separately.

9.2 The Customer is responsible for ensuring quantities are correct and for declaring allergies. The Picnic Collective does not guarantee allergen-free items.

10. General

10.1 This Agreement and Booking Form constitute the entire agreement.

10.2 Each booking is a separate contract under this Agreement.

10.3 If any clause is unenforceable, the remainder remains valid.

10.4 Clauses 1, 5–10 survive termination.

10.5 Special conditions in a confirmed Booking Form take precedence.

10.6 This Agreement is governed by laws in the relevant Location.

10.7 Equipment must not be used commercially without prior written approval.

11. GST

11.1 Terms not defined in this clause take the meaning from GST law.

11.2 All charges are exclusive of GST unless otherwise stated.

11.3 Where GST applies, it must be paid in addition to the agreed charges.

11.4 GST must be paid on or before the due date or within 7 days of receiving an invoice.

12. Participant Waiver and Risk Warning

In accordance with section 34 of the Civil Law (Wrongs) Act 2002 (ACT) and section 139A of the Australian Consumer Law, the Participant acknowledges that participating in a picnic may present risks including:

  • Death;

  • Physical or mental injury;

  • The aggravation or recurrence of existing conditions.

By hiring, the Participant acknowledges:

  • Awareness of such risks;

  • Limited rights to sue The Picnic Collective;

  • That The Picnic Collective is released from liability except for significant personal injury due to negligence.

Parents/Guardians consent to these terms on behalf of minors and must supervise at all times.
